Any tax professional with an IRS Preparer Tax Identification Number (PTIN) is authorized to prepare federal tax returns, including certified public accountants, enrolled agents, attorneys, and others who don’t have professional credentials. Enrolled agents, certified public accountants, and attorneys generally have unlimited representation rights because of their credentials:

  • An enrolled agent (EA) is licensed by the IRS following the successful completion of a comprehensive exam in federal tax planning; individual and business tax return preparation; and representation. EA’s also undergo a background check before their license is granted and must comply with ethical requirements, completing a course in ethics each year, and complete a minimum of 24 hours of continuing education approved by the IRS in order to maintain their license.
  • Certified public accountants (CPAs) are licensed by state boards of accountancy after passing the Uniform CPA Exam. CPAs need to have graduated with a degree in accounting and met good character requirements established by the state boards. CPAs must also comply with ethical requirements and complete continuing education to maintain their license.
  • Attorneys are licensed by state courts or state bar associations after successfully passing the bar exam. They must also have a degree in law and participate in on-going continuing education and professional character standards to maintain their licensure.

Other tax return preparers, such as seasonal tax help, who lack one or more of the credentials listed above have only limited rights to represent you before the IRS.
